Overview

This website is operated by Holmes Clothing Inc, doing business as The Missionary Store and Holmes Clothing ("we," "us," "our"). These Terms of Service apply to themissionarystore.com, missionaryclothing.com, and any purchase you make from us online. By visiting our site or buying from us, you agree to these terms and to the policies they link to. If you don't agree, please don't use the site.

We may update these terms by posting a new version on this page. Your continued use of the site after an update means you accept the changes. Our store is hosted on Shopify Inc.

1. Using our store

By using this site, you confirm that you are at least 18 years old or the age of majority where you live, or that you have permission from a parent or guardian. You may not use our products or this site for any illegal or unauthorized purpose, and you may not upload viruses or any harmful code. If you break these terms, we may end your access to the site.

2. General conditions

We may refuse service to anyone for any reason. Card information is always encrypted when it is sent. You may not copy, resell, or exploit any part of the site or its content without our written permission. Section headings are for convenience only.

3. Accuracy of information

We work to keep product and site information accurate and current, but we don't guarantee it. Information on the site is for general use and may change without notice.

4. Prices and products

Prices may change without notice. We may change or discontinue products or parts of the site at any time. We try to show product colors as accurately as possible, but your screen may show them differently. We may limit quantities, or limit sales to certain people or regions.

5. Orders and billing

We may refuse or cancel any order, or limit quantities per person, household, or order, including orders that appear to come from resellers. If we change or cancel your order, we'll try to contact you using the email, phone, or address you gave us. Please keep your account and payment information current and accurate.

6. Returns and exchanges

Returns and exchanges follow our Return and Refund Policy.

Instant exchanges: if you choose an instant exchange, we ship your new item before your return arrives. By choosing it, you authorize us to keep your payment card on file and charge it for the new item if you don't send the original back within the time shown when you start the exchange.

7. Altered and tailored items

Alterations such as hemming and sleeve changes are made to your measurements. Once an item has been altered or tailored, it is final sale and can't be returned or exchanged, unless the alteration was our mistake.

8. Return coverage and package protection

At checkout you may be offered optional return coverage and package protection, provided through our returns partner, Redo. What each one covers and costs is shown at checkout and in our Return and Refund Policy. Returns made without return coverage are subject to a return shipping fee, shown in our returns portal before you confirm. Fees for return coverage and package protection are not refundable, including when you return items.

9. International orders

If you order from outside the United States, our international checkout partner may sell and ship your order as the seller of record and collect duties and taxes at checkout. When that happens, that partner's terms and privacy policy also apply to your order.

10. Text messages

If you sign up for text messages, our Mobile Terms of Service also apply.

11. Optional tools and third-party links

We may give you access to third-party tools and links to other websites that we don't control. They are provided "as is," and your use of them is at your own risk and subject to their own terms. We aren't responsible for third-party content, products, or services.

12. Comments, reviews, and feedback

If you send us comments, reviews, ideas, or other material, we may use, edit, and publish them without paying you or keeping them confidential. You agree that what you send won't be illegal, abusive, or misleading, won't violate anyone's rights, and won't contain viruses. You are responsible for your own comments.

How we collect and use your personal information is explained in our Privacy Policy.

14. Errors and omissions

The site may sometimes contain errors in product descriptions, pricing, promotions, shipping charges, or availability. We may correct errors, and change or cancel orders affected by them, at any time, including after you've placed your order.

15. Prohibited uses

You may not use the site or its content to break any law; infringe anyone's intellectual property; harass, abuse, or discriminate against anyone; submit false information; upload malicious code; collect other people's personal information; spam, phish, scrape, or crawl the site; or interfere with its security. We may end your use of the site if you do.

16. Disclaimer and limitation of liability

We don't guarantee that the site will be uninterrupted, secure, or error-free. Except as we state otherwise, the site and our products are provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. Holmes Clothing Inc and its owners, employees, and partners are not liable for indirect, incidental, special, or consequential damages arising from your use of the site or our products. Where the law doesn't allow these limits, our liability is limited to the fullest extent the law permits.

17. Indemnification

You agree to defend and hold harmless Holmes Clothing Inc and its owners, employees, and partners from any claim, including reasonable attorneys' fees, caused by your breach of these terms or your violation of any law or anyone else's rights.

18. Severability

If any part of these terms is found unenforceable, it will be enforced to the extent allowed, and the rest of the terms remain in effect.

19. Termination

These terms apply until ended by you or us. You can end them by no longer using the site. We may end them, or your access to the site, at any time if you don't follow them. Amounts you owe up to that date remain due.

20. Entire agreement

These terms, together with the policies they link to, are the entire agreement between you and us about your use of the site, and they replace any earlier versions. If we don't enforce a right, we haven't waived it.

21. Governing law

These terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Weber County, Utah.
